Drug-Free Workplace and Campus: January 1999 Policy Statement.

The unlawful manufacture, distribution, dispensation, possession or use of a controlled substance is prohibited on Northern Kentucky University (NKU) owned or controlled property. Any NKU employee determined to have violated this policy may be subjected to disciplinary action up to and including termination. A controlled substance, as referenced in the federal Drug-Free Workplace Act of 1988 and defined in the federal Controlled Substance Act, does not include alcohol. However, the use of alcohol while on NKU owned or controlled grounds, including meal periods and breaks, is absolutely prohibited except when authorized by the University for approved University functions. No employee will report to work while under the influence of alcohol (as defined by the Department of Transportation) or illegal drugs. An employee with obvious signs of mental or physical impairment, thought secondary to alcohol or illegal drug use, or when job related behavior or work performance suggests that the employee is under the influence of alcohol or illegal drugs, may be required to take a breath test using an evidential breath testing device (EBT), report to the nearest approved drug testing facility, or leave the premises until an investigation is conducted. The employee's supervisor shall arrange safe transportation. Violation of this policy by an employee will be reason for mandatory evaluation/treatment for a substance use disorder or for disciplinary action up to and including termination of employment.

In order to comply with the federal Drug-Free Workplace Act of 1988, (41 USC 701, et seq.) each employee is notified that, as a condition of employment, he/she must abide by this POLICY STATEMENT, and notify NKU of any criminal drug statute conviction for a violation occurring in the workplace no later than 5 days after such conviction. Failure to abide by the provisions of this POLICY STATEMENT may result in disciplinary action up to and including termination. The University will impose a sanction on, or require the satisfactory participation in a drug/alcohol abuse assistance or rehabilitation program by any employee who is so convicted.

The University must notify any federal granting or contracting agency within 10 days of having received notice that an employee engaged in the performance of such grant or contract has had any criminal drug statute conviction for a violation occurring in the workplace.

Any employee engaged in the performance of a grant or contract from the United States Department of Defense will be required to meet the requirements of the Drug-Free Work Force regulations (48 CFR 223.75) and may be subject to drug testing, as prescribed by the funding agency.
