Overtime and Compensatory Time

D 1.1
The statutory workweek of the University is a period of 168 consecutive hours beginning at midnight on Saturday and ending at midnight the following Saturday (Sunday through Saturday). For those department which operate on a 24-hour basis, the statutory workweek begins at the start of the last regularly scheduled shift which commences on Saturday night and extends through Sunday morning.

The normal operating hours of the University are 8:15 a.m. to 4:30 p.m., Monday through Friday. Some departments must alter or extend this schedule in order to provide necessary services. Work schedules will be announced and maintained within the individual departments.
D 1.3
A lunch period of forty-five minutes is normally granted to employees who work seven and a half hours per day. For employees who work eight hours per day the lunch period is normally thirty minutes. Some department must alter the length of lunch periods in order to provide necessary services.
D 1.4
No employee shall be required to take a lunch period sooner than three hours, nor later than five hours after the start of the workday unless there is mutual agreement between the employee and the department head.
D 1.5
Employees who work seven and a half hours per day will be granted one ten minute break prior to lunch and one ten minute break after lunch. In lieu of two breaks the employee may, with the supervisor's consent, take one twenty minute break during the workday.
D 1.6
Employees who work eight hours per day will be granted one fifteen minute break prior to lunch and one fifteen minute break after lunch.
D 1.7
Department heads should advise Human Resources of any deviations from the normal lunch periods or the normal operating days or hours.
OVERTIME AND COMPENSATORY TIME
D 2.1
Executive, administrative, and professional positions are exempt from Kentucky state overtime laws, and are therefore not eligible for overtime pay, holiday pay, or compensatory time off for services rendered in excess of the normal work hours. Exemption is determined on the basis of job duties, responsibilities, and in some cases, educational attainment.
D 2.2
When a new position is being created, the Major Department Head should review with the Director of Human Resources the nature of the position in order to determine whether it is exempt or not.
D 2.3
Positions other than executive, administrative, and professional are non-exempt, and therefore subject to all provisions of the Kentucky laws.
D 2.4
As a general policy it is expected that the University's various work loads should be accomplished within the regular workweek. Emergencies or unforeseen circumstances, however, may create a necessity for employees to work extra hours. Control over any extra hours worked rests with the Department Head; however, in emergency situations authority for an employee to work extra hours may be granted by the employee's immediate supervisor.
D 2.5
Employees will be compensated at their straight-time rate for all hours "actually worked" up to a total of 40 hours in one workweek.
D 2.6
In order to comply with Kentucky state laws, all hours "actually worked" in excess of forty hours in a workweek must be paid at the rate of one and one-half times the regular rate of pay.
D 2.7
Compensatory time off in lieu of payment for overtime is permitted only in accordance with the following:
Employees whose regular workweek is less than forty hours may be granted an equal amount of straight-time off for extra hours "actually worked" up to forty hours in a workweek. The decision to grant time off or to pay for the extra time is reserved to the Department Head. If compensatory time off is granted, it must be taken by the end of the current pay period.
D 2.8
The following leaves which the staff member has earned and is entitled to will be included in calculating hours "actually worked" during the workweek:
A. Vacation Leave
B. Funeral Leave
C. Court or Jury Duty Leave
D. Time off due to illness or injury covered by Worker's Compensation
E. Time off for voting in National, State, and local elections, but only in accordance with Section F10
D 2.9
In calculating hours "actually worked", Temporary Disability (Sick) leave will not be included. If the employee has earned and is entitled to Temporary Disability leave, hours taken during the workweek on this leave will be considered as hours worked, but in no case will the employee be paid at a rate greater than straight-time for such leave.
